Terms of Service

1. Acceptance of Terms

By accessing and using the services provided by BizWiz Tech Inc. ("Company," "we," "us"), including but not limited to web development, managed IT services, and digital marketing, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

BizWiz Tech Inc. provides digital transformation services, including:

  • Custom Website and Application Development
  • Proactive Managed IT Services (RMM, Security, Support)
  • Digital Marketing and SEO Subscriptions
  • Hardware Procurement

Specific deliverables for your project will be outlined in a separate Statement of Work (SOW) or Proposal.

3. Payments and Billing

One-Time Projects: A deposit (typically 50%) is required to commence work, with the balance due upon project completion or launch.

Recurring Services: Managed IT and Marketing subscriptions are billed monthly in advance. Automatic payments may be processed via our secure payment processor (Square). Late payments may result in a temporary suspension of services.

4. Intellectual Property Rights

Upon full payment of all fees, the Client is granted full ownership of the final website design and custom code created specifically for their project. BizWiz Tech Inc. retains the right to reuse underlying code libraries, tools, and generic components. All background technology (e.g., our "Command Center" platform) remains the property of BizWiz Tech Inc.

5. Limitation of Liability

To the fullest extent permitted by applicable law, BizWiz Tech Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption, arising out of or in connection with the use of our services.

6. Termination

Either party may terminate a recurring service agreement with 30 days' written notice, unless a specific contract term (e.g., 12 months) applies. We reserve the right to terminate services immediately for violations of these terms or non-payment.

7. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
